Expert: Approved offshore wind turbine project may be in violation of EU law

In December, the Danish Energy Agency granted permission to build 16 offshore wind turbines in Jammerland Bugt. However, according to a legal expert, this permit may be in conflict with EU law and risk being revoked. This is reported by TV2 Øst.

- Based on the things that I can see and the decisions that are available, it is my assumption that the establishment permit will be invalid and should be revoked, says Kenneth Løvenskjold Andreasen, who is a PhD fellow in climate and energy law at the University of Southern Denmark and has previously worked in, among other places, the Energy Complaints Board.

The case regarding the offshore wind turbines in Jammerland Bugt has now been brought before the Energy Complaints Board, but may ultimately end up at the European Court of Justice. However, the Danish Energy Agency maintains that it follows the Ministry of Environment and Gender Equality's guidance on the Environmental Assessment Act, which does not require a strategic environmental assessment of the project. The offshore wind turbines in Jammerland Bugt are currently expected to be operational in 2029, and will be able to supply around 240,000 households with electricity.
