Agreement leaked: Port of Aarhus would give Maersk first right to new areas after expansion

The Maersk company APM Terminals had secured the first right to the new 43 hectares of new land through a so-called Memorandum of Understanding (MoU) with the Port of Aarhus, which was supposed to have constituted an expansion of the port, but which was postponed indefinitely in June. This would allow the company to match all offers from other parties interested in the area. This is stated in the agreement, which Din Avis Aarhus has obtained.

"APMT is willing to cooperate with AAH (Port of Aarhus, ed.) as desired and share its expertise and experience with AAH to further develop the plan for a new container terminal and will, on this basis, be given a right of first refusal to lease and operate such a new container terminal," the agreement states, among other things, according to the local media.

According to CBS professor Peter Maskell, one of the country's leading experts in the port area, such an agreement would create a situation where there would be "no opportunity for competition." But the agreement does exist, and it is partly on this basis that APMT has taken the port to court, as the port allegedly intends to let Maersk's largest competitor MSC become the operator of an unused 16-hectare area at the port. According to the newspaper, the port believes that the agreement only deals with a possible expansion, while APMT believes that the intention of the agreement is to have a right of first refusal to a future area for container handling regardless of location.
