SF in Kerteminde is withdrawing the Port of Odense from the Danish Appeals Board.

KERTEMINDE / ODENSE: SF in Kerteminde Municipality has submitted a complaint to the Danish Social Appeals Board with accusations that Odense Havn A/S is acting as a property developer instead of sticking to traditional port operations. The Odense Dryport project in Årslev in particular – located 23 km from the nearest quay – has attracted attention. SF does not believe that the location meets the requirements of the Port Act, which requires a port relationship. This is reported by Fyens Stiftstidende.

- We do not believe that this can be accommodated within the Port Act. We believe this is property development, and we believe this is illegal, says Alex Haurand, a city council member in Kerteminde for SF, who therefore asked the Danish Social Appeals Board on behalf of SF to assess three matters that the party believes are in conflict with the municipal mandate. They concern Odense Dryport, support for EU applications and a cooperation agreement from 2024, which involves housing construction and infrastructure development.

According to professor of administrative law Sten Bønsing, however, it is the Port Act and not the municipal mandate that is probably the most relevant legal framework. He emphasizes that the Port Act is designed to ensure that ports are used for activities directly related to maritime transport. According to the professor, a violation of the Port Act "can in the worst case lead to an injunction against doing business".
