RINGKØBING-SKJERN: Two city council politicians were incompetent when the local plan for a biogas plant in No ved Ringkøbing was adopted by the Ringkøbing-Skjern city council just over two years ago.
The Planning Appeals Board has decided this, and the board has therefore revoked the local plan, the municipality informs.
A neighbor to the planning area had complained about the local plan because the complainant believed that three city council members were incompetent. The Appeals Board concludes that this applies to two of the three.
The municipality's own lawyers had also originally assessed that the three politicians were incompetent - technical and environmental committee chairman Ole Nyholm Knudsen, because he was director of Vestjysk Biogas, and the other two because they had close family members with interests in the case. But after consulting the City Council, the assessment was changed at the time.
Complex case
- We take note of the decision from the Planning Appeals Board and will now delve into the consequences the decision will have for the future of the project, says Mayor Hans Østergaard (V).
- This is a complex case, where the municipality's own lawyers, after a request from the politicians in question, have been involved - and after a general assessment from the City Council's lawyers - have assessed that the politicians in question were not incompetent. I also think that complexity, the decision from the Planning Appeals Board is an expression of, in that two city council members have been declared incompetent, while one is not, he says.
The municipality will now, in dialogue with the applicant, decide on the future of the project.
According to Dagbladet Ringkøbing-Skjern, it is RKB Bioenergi A/S, owned by around 50 local farmers, and DBC Invest A/S, that is behind the project, which has not yet been started.
In March this year, the Danish National Appeals Board also assessed that not two, but all three city council politicians were incompetent in the case.
While the neighbor was successful in the question of incompetence in the Planning Complaints Board, his other complaints were over the local plan rejected by the appeals board.
