Energinet is being prosecuted for acting in violation of the law

The Danish Electricity Supply Authority has issued a reprimand to Energinet for having changed a method in the electricity market without first obtaining permission.

Since February 2024, Energinet has used a new method to calculate and purchase so-called frequency control reserves (FCR) in Eastern Denmark and Sweden.

According to the Danish Electricity Supply Authority, since February 2024, Energinet has used a new method to calculate and purchase balancing capacity from so-called frequency control reserves (FCR) in Eastern Denmark and Sweden, without the change having first been approved.

This is in violation of the rules in the European Electricity Balancing Regulation, which requires that such changes must be approved before they are put into use:

"Energinet has disregarded the requirement in the Electricity Balancing Regulation that Energinet's methods, including changes to the methods for establishing common and harmonized rules and processes for the exchange and acquisition of balancing capacity, must be approved by the Danish Electricity Supply Authority before the change can be put into use," the authority's decision states.

Energinet continued to use the new method even after the regulator was made aware of the matter. It was not until March 2025 that the company notified the change, which was approved in September.

The Danish Electricity Supply Authority emphasizes that the reprimand is being given because the rules were violated, even though the error has now been corrected.
