New law ensures faster clarification for landowners in electricity grid projects

Energinet will be able to offer early expropriation to affected landowners

From 1 January 2026 came into force. The new law standardises the processes for expropriation in the expansion of the electricity grid and shortens the waiting time for landowners who are affected by new construction projects. The law stems from recommendations from the national energy crisis team, NEKST, in which Energinet has participated. This is stated by the state-owned company in a press release.

With the amendment to the law, Energinet – in line with the Danish Road Directorate and Banedanmark – will be able to carry out direct expropriation and offer early expropriation to particularly affected landowners. This is intended to reduce the period during which landowners live in uncertainty about future projects.

- It is good that we can now offer early expropriation to landowners who are severely affected. It provides security and predictability, and it is something we have wanted for a long time. Unfortunately, on several of our other projects, we have had families who have waited an unreasonable amount of time for clarification until all permits were in place, says Marian Kaagh, deputy director of Energinet.

The legislative amendment is intended to create more predictable and flexible processes so that projects can be implemented at the pace required by the green transition. At the same time, the legal position for neighbors is strengthened, who can have any property value losses assessed by the Expropriation Commission - even if no actual expropriation is carried out.

- In connection with the expansion of the electricity grid, we cannot prevent landowners from being affected, but our greatest wish is that we can provide landowners who are in a difficult personal situation with a faster clarification. We have been given that opportunity with the new legislation,” she explains. 

Energinet emphasizes that dialogue with landowners and neighbors will continue to be central, and that voluntary agreements will continue to be the main model for cable projects.
