After meeting and hearing about the case of shipowner Jørgen Holm Christensen, the chairman of the Danish People's Party, Morten Messerschmidt, sent the following question to the Minister of Transport:
"Will the Minister investigate the specific case mentioned in the article "Snydt af Femern A/S: Shipowner seeks help from Messerschmidt at Christiansborg", published on DK Indkøbs website on May 16, 2023, about a shipowner who does not believe that Femern Bælt A/S has complied with an oral agreement? And will the Minister investigate whether such oral agreements are generally concluded agreements, and if so, whether these are in accordance with the legislation?"
The Ministry of Transport is the owner of the state-owned company Femern Bælt A/S.
The following response was then received from Transport Minister Thomas Danielsen (V):
"I have submitted the questions to Femern A/S, which provides the following information:
In connection with the start of environmental studies on the Fehmarn Belt project, a written boat rental agreement was entered into in 2009 between the company Øresund Bådservice ApS, owned by Jørgen Holm Christensen, and Femern A/S.
In 2012, Øresund Bådservice ApS and Femern A/S entered into a written agreement to terminate the collaboration. It appears from the termination agreement that it was a full and final statement of the parties' balances, and that the parties jointly declared that neither party had any further claims against each other.
In 2018, Øresund Bådservice ApS went bankrupt.
In 2020, Jørgen Holm Christensen personally claimed through his lawyer, Middelfart Advokaterne, that Femern A/S, in connection with the termination of the agreement between Øresund Bådservice ApS and Femern A/S in 2012, should have made an oral promise to Jørgen Holm Christensen personally about future boat assignments.
On behalf of Femern A/S, the Chamber Advocate has handled the case and handled the exchange of letters with Jørgen Holm Christensen's lawyer. In this connection, Jørgen Holm Christensen has been requested to submit documentation for the claim that Femern A/S has given Øresund Bådservice ApS and/or Jørgen Holm Christensen a legally binding promise about future boat assignments. The Chamber Advocate has not currently received such documentation.
Based on case files, interviews with people involved in Femern A/S and available documentation, the Attorney General has assessed that no legally binding promise has been given regarding future work either to Øresund Bådservice ApS or to Jørgen Holm Christensen.
As a state-owned company, Femern A/S is regulated by public procurement and EU legislation. The tender for the Fehmarnbelt project is thus carried out in accordance with applicable rules and laws, and there is no practice of entering into oral agreements with suppliers for the project. It is noted in this connection that the Fehmarnbelt project has been granted significant EU funding. This means that Femern A/S must continuously document its costs to the European Commission, and that the European Court of Auditors must continuously monitor the project's reporting of costs and tender processes for the project's contracts.”
On the basis of the information provided, I do not see any need to take any further action in the case.
