Most of the tariffs that US President Donald Trump has imposed on foreign goods are against the law. A US appeals court ruled on Friday.
Specifically, the court has ruled on the tariffs that Trump has referred to as retaliatory tariffs, where he has imposed tariffs on goods from a wide range of countries. At the same time, the court has assessed the tariffs that were imposed in February on goods from China, Canada and Mexico. In both cases, the appeals court has concluded that Donald Trump does not have the authority to impose the tariffs.
- The law gives the president broad powers to act in response to a declared national crisis. But it does not directly state that these actions can involve imposing tariffs or taxation, the decision says.
The court will leave the tariffs in effect until October 14, so that the Trump administration has the opportunity to appeal the case to the country's Supreme Court. Attorney General Pam Bondi has confirmed that the administration will do so.
- This decision is wrong and undermines the United States on the global stage, she writes on X.
Donald Trump himself has also reacted to the decision. In a post on Truth Social, he calls the appeals court biased and writes that it will be a total disaster for the United States if the tariffs are removed.
- It will make us financially weak, and we need to be strong. The United States will no longer tolerate huge trade deficits and unfair tariffs and other trade barriers imposed by other countries - friend or foe - that undermine our manufacturers, farmers and everyone else, Trump writes.
He adds that with the help of the country's Supreme Court, the tariffs will benefit the country. While the appeals court has ruled that most of Trump's tariffs should be removed, this does not apply to tariffs on, for example, steel and aluminum. Here, the tariffs have been introduced on a different legal basis.
It was back in February, shortly after his inauguration as president, that Trump imposed tariffs on goods from China, Canada and Mexico.
Trump then said that tariffs would be imposed on goods from even more countries - including EU countries. He has described these tariffs as retaliation for trade barriers.
The EU and the US have since concluded a trade agreement, which means that the US will initially impose a 15 percent tariff on goods from the EU.
